Can I still keep my home?
Every situation is different, but most of the time people are able to keep their homes. If they have fallen behind in payments, they may still be able to keep their home if they can afford the regular monthly payment and a small payment toward the arrears via chapter 13 bankruptcy.

If I file, will creditors stop harassing me?
Once you have filed for bankruptcy, your creditors are required by law to stop contacting you. In the event that you are contacted, you should refer them to us.

Will I ever restore my credit?
Most mortgage lenders will approve you for a car or home loan after a couple of years, if you are otherwise qualified. There are many ways to rebuild your credit, and you can do so immediately after filing for bankruptcy. We will show you how.

Can I still file under the new law?
You can still file for both chapter 7 and chapter 13 bankruptcy under the new law. There are more restrictions, but an experienced bankruptcy attorney can guide you through the complicated provisions of the new bankruptcy law.

What is a chapter 7 trustee?
A chapter 7 trustee is an individual appointed by the bankruptcy court to administer a bankruptcy case. The trustee is responsible for reviewing a case, liquidating assets that are not exempt and distributing the proceeds to creditors.

What is a chapter 13 plan?
This is a repayment plan which your attorney will propose to the bankruptcy court. The amount of the monthly payment is based upon your income and regular monthly expenses. You may not have to repay all of your debt in a chapter 13 plan, but you will contribute what you can afford over a period of 3 - 5 years.

How will filing for bankruptcy affect my credit?
There are many ways to rebuild credit. If you file for chapter 7, you will have to begin rebuilding your credit from scratch, but there are ways to do so, and we can help you determine the best way. If you file for chapter 13 bankruptcy, you will begin the process of rebuilding your personal credit by making the necessary payments through your chapter 13 plan. Most people find that they can rebuild their credit and obtain loans for a home or car within one - two years.

What is a discharge?
