There are two types of probate administration in Florida, formal administration and summary administration.

Formal Administration

This type is required if the estate involves more than $75,000. in assets. The will is admitted to court, a personal representative is appointed, and letters of administration are signed by the judge, authorizing the personal representative to act on behalf of the estate. A notice of administration is sent to interested persons (the surviving spouse, the beneficiaries, etc.), and a notice to creditors is published to identify unknown creditors, and it is also mailed to all known creditors. Creditors are told they have 90 days to file a claim with the court. If not filed, they could lose their right to collect on the debt.

Assets are collected; the debts and taxes are paid. After all assets have been distributed, the estate is closed and the personal representative is relieved of all duties.

Summary Administration

A shorter version of a formal probate, summary administration can be used if the value of the estate is $75,000. or less, or if the decedent has been dead for more than two years.
